António Gaspar Schwalbach appeared on the “Negócios” TV program on NOW to discuss the legal mechanisms available to taxpayers challenging tax assessments issued by the Portuguese Tax Authority.
The discussion focused on the different procedural alternatives available to companies, including the possibility of suspending tax enforcement proceedings through the provision of guarantees, as an alternative to the immediate payment of the tax assessments, without prejudice to challenging the legality of such assessments before the courts.
“The strategies adopted by companies in these cases may differ depending on the legal and financial context involved”, noted the founder of Spear Legal.
“The legality of the assessment ultimately remains subject to judicial review by the administrative courts,” he added.
